Student paper wins national award

Western Law student Dina Milivojevic has won first place in the 2012 Insolvency Institute of Canada’s Law Student Writing Award Competition.

Milivojevic received the award for her paper “The Canadian Recognition of Foreign Insolvency Proceedings: Comity, Public Policy and Judicial Discretion” written for professor Chi Carmody’s International Business Transactions course. The paper deals with the recognition of foreign bankruptcy proceedings by Canadian courts.

Milivojevic, who is currently articling at Davies LLP in Toronto, will receive a cash prize of $5,000 and an invitation to present her paper at the 2012 Insolvency Institute’s Annual Conference, to be held Sept. 20-23 in Whistler, B.C.

“With a growing tendency of Canadian courts to accept and enforce foreign judgments and awards, the question of the recognition of foreign proceedings in matters like bankruptcy and family law becomes important,” said Carmody. “Dina’s work on the subject of Canadian judicial recognition of foreign bankruptcy proceedings was timely, exceptionally well-researched, and to the point. She’s to be commended for this significant achievement.”
